Washington Court Limits Kalshi: What Learners Should Know

On July 21, 2026 a King County Superior Court judge, John McHale, granted Washington a preliminary injunction that bars Kalshi from offering most of its event contracts to state residents, finding that the platform has likely violated the Washington Gambling Act and related consumer protection laws. The injunction will remain in place while the court considers a final order that is expected in early August, and the ruling followed briefing and argument over whether the contracts are lawful wagers or federally regulated exchange products.

Kalshi operates an online exchange for prediction contracts that let users take positions on sports results, political events and economic outcomes, and the company has argued that the Commodity Futures Trading Commission regulates such markets. The CFTC has been active this year, having stayed a KalshiEX rule change and exercised emergency authority to order fulfillment of trades; federal filings and agency actions have therefore become central to the legal disputes that multiple states have mounted. Courts in several states, including Michigan and New York, have issued rulings that limit Kalshi’s offerings while litigation proceeds.

For Washington residents the immediate effect is practical: many markets are blocked and new trades by state users are restricted until the court sets a permanent remedy. Kalshi has stated that it will contest the state cases and appeal as necessary, and parties will return to court for further briefing and orders. Nevertheless, the series of state and federal decisions this year is already reshaping how prediction markets will operate in the United States, with regulators and judges defining the boundaries between gambling law and federal derivatives oversight.
