On May 5, 2026 the U.S. Food and Drug Administration issued marketing orders that authorized four Glas electronic nicotine delivery systems, marking the first time the agency has allowed non-tobacco and non-menthol flavored pods. Each authorized pod contains 50mg/ml (5%) tobacco-derived nicotine, and the agency noted that these actions bring the total number of authorized ENDS products to 45. While the move expands legal market access for specific flavored options, the FDA emphasized that the orders apply only to these four products.
Glas’s application was judged to include device access restriction technology that links a verified user’s government-issued ID to a smartphone via Bluetooth and requires periodic biometric checks. If these controls function as intended, the agency concluded they can reduce youth access while allowing adults who smoke to switch. However, manufacturers must track and report how audiences see their marketing and must limit promotion to adults aged 21 and older.
Earlier, on March 11, 2026 the FDA published a draft guidance describing how reviewers should balance youth risk and adult benefit when evaluating flavored e-cigarettes; public comments were invited through May 11, 2026. At the same time, retailers and trade groups have warned that illicit disposable e-cigarettes made in China have grown in U.S. sales and may undercut legal controls, and public health advocates note that smoking still causes about 480,000 U.S. deaths each year.
The FDA will monitor product marketing and has the authority to suspend or withdraw authorizations if youth use rises or if benefits no longer outweigh risks, a safeguard that remains in place as the agency continues enforcement work at U.S. borders and ports.
